In this webinar, Litigation Updates: Implications for Survivor Representation, presenters will share a discussion about recent litigation developments affecting survivors. ASISTA staff and guest speakers will address cases including ASISTA v. Johnson, No. 3:20-cv-00206-JAM (D. Conn.) (formerly known as ASISTA v. Albence) (regarding unlawfulness of Matthew Albence’s appointment as Acting Director of ICE); Medina-Tovar v. Zuchowski, 982 F.3d 631 (2020) (finding that U derivative spouses need only have a qualifying relationship to the principal at the time of adjudication); and N-N- v. Mayorkas, No. 1:19-cv-05295-EK (E.D.N.Y) (regarding USCIS’s unreasonable delay in adjudicating cases for placement on U visa waitlist). We will also discuss the potential implications of these cases for representing survivors before USCIS and EOIR.
